Terms of Use
This online personals service is a way for adults to meet each other (the "Service").
This legal agreement is made between You and Us ("Agreement"). This Agreement applies to all of our websites and applications that are offering the Service. Please read this Agreement carefully before using or registering for the Service. By using or registering for the Service, You become a member (a "Member"), and You agree to be bound by the terms and conditions of this Agreement for as long as You continue to be a Member. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT USE THE SERVICE.
In this Agreement the following words have the following meanings unless the context requires otherwise:
"Agreement" means the agreement between You and Us incorporating these terms and conditions for the provision of the Service, as amended from time to time in accordance with the terms and conditions set forth herein;
We, Us, Our, the Company" means the Service; and
"You, Your, Yourself" means the person who registers for the Service, accepts the terms and conditions of this Agreement and whose application for membership of the Service is accepted by Us.
ELIGIBILITY: MINORS MAY NOT BECOME MEMBERS. By becoming a Member, You represent and warrant that You are at least 18 years old. By using the Service, You represent and warrant that You have the right, authority and capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement. Your membership for the Service is for Your sole, personal use. You may not authorize others to use Your membership and You may not assign or otherwise transfer Your account to any other person or entity.
REGISTRATION AND SUBSCRIPTION:You agree to provide accurate, current and complete information about Yourself as prompted by Our registration form ("Registration Data"), and to maintain and update Your information to keep it accurate, current and complete. You agree that We may rely on Your Registration Data as accurate, current and complete. You acknowledge that if Your Registration Data is untrue, inaccurate, not current or incomplete in any respect, We reserve the right to terminate this Agreement and Your use of the Service.
TERM AND TERMINATION. This Agreement remains in effect while you use the Service and while you are a Member. You may terminate your membership at any time, for any reason, by deleting your account at https://www.buzzarab.com/delete_profile.php.
We may suspend your membership, or remove specific content you have posted, if we reasonably believe that you have violated this Agreement, that your conduct on the Service is harmful to other Members or to Us, that your continued use of the Service creates legal risk for Us, or in other circumstances where suspension is reasonably necessary to protect the Service.
Statement of reasons. Where We suspend your membership, or remove your content, We will provide you with a clear and specific statement of the reasons for Our decision, except where:
(a) we are prohibited from doing so by law, court order, or law enforcement request;
(b) doing so would compromise an ongoing investigation into fraud, abuse, or child safety;
(c) the violation involves content that we are required by law to remove or report (such as CSAM); or
(d) you have created repeat accounts after a previous termination.
Appeal. If you believe Our decision was incorrect, you may submit an appeal via Our "Contact Us" / "Feedback" page at https://www.buzzarab.com/feedback.php within six (6) months of the decision. Your appeal should include your account information and the reasons you believe the decision should be reversed. We will give it human (not solely automated) review, and respond within a reasonable time, generally within thirty (30) days.
Out-of-court dispute resolution. If you are located in the European Union, you may also refer disputes about Our content moderation decisions to a certified out-of-court dispute settlement body listed by the European Commission under Article 21 of the EU Digital Services Act.
Refunds on termination. If We suspend your membership for a violation of this Agreement, you are not entitled to a refund of any prepaid amounts. If you terminate your membership voluntarily, the refund policy described elsewhere in this Agreement applies.
Effect of termination. When you voluntarily delete your account, your profile and content are removed in accordance with Our Privacy Policy. When We suspend your membership for a violation of this Agreement, your access to the Service is disabled and other Members can no longer contact you. We may retain your account information and Your Content to investigate the violation, prevent the creation of repeat accounts, comply with legal obligations, and defend against legal claims. Provisions of this Agreement that by their nature should survive termination or suspension — including the License to Us section, the Indemnity, Limitation of Liability, Disclaimers, and Dispute Resolution sections — will continue to apply.
PROTECTION OF CHILDREN: We are committed to protecting children and preventing the sexual exploitation and abuse of children. We adhere to industry standards and legal requirements to prevent the use of our platform for such purposes. We cooperate with law enforcement agencies and other organizations to report and combat child sexual abuse and exploitation. We prohibit any form of Child Sexual Abuse and Exploitation (CSAE) in our services. We prohibit the sharing of any child sexual abuse material (CSAM) in our services. We prohibit any content or behavior that sexually exploits, abuses, or endangers children. This includes, for example but not limited to, grooming a child for sexual exploitation, sextorting a child, trafficking of a child for sex, or otherwise sexually exploiting a child.
•If you come across any instances of CSAE or CSAM while using our services, please report it immediately using the Report page available both in the conversation page with a member and in a member's profile page.
•We report all confirmed instances of CSAE or CSAM to the relevant regional authorities.
REFUND POLICY: All purchases and/or subscriptions are NON-REFUNDABLE. We may, at our own discretion, give refunds for a number of other reasons.
YOUR CONTENT. You retain ownership of the content you post on the Service, including your profile information and photographs ("Your Content"). You represent and warrant that you have all rights necessary to post Your Content and to grant the license below, and that Your Content does not infringe the rights of any third party.
LICENSE TO US. By posting Your Content on the Service, you grant to Us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (including to create thumbnails, resize, or reformat), publish, publicly display, communicate to the public, distribute, and create derivative works from Your Content, for the purposes of: (a) operating, providing, and improving the Service; (b) showing Your Content to other Members in accordance with your visibility settings; (c) promoting the Service, including in newsletters and editorial features in which we may include your profile (without using your real name or contact details); and (d) complying with legal obligations and enforcing our Terms.
DURATION. The license continues for as long as We hold Your Content in any of Our systems, including backup and archival systems, even after you delete it from the Service. When you delete content or your account, We will stop displaying it on the Service and stop new forward-looking uses, but the license continues to apply to copies that remain in: (i) the records of other Members with whom you shared Your Content; (ii) materials We are required to retain for legal, regulatory, or evidentiary reasons; (iii) materials We have already published (such as past newsletters) that we cannot reasonably retract; and (iv) Our routine backups, which are deleted on Our standard backup-rotation schedule.
MORAL RIGHTS. To the extent permitted by the laws of your jurisdiction, you waive moral rights in Your Content in favour of Us, solely to the extent necessary for the licensed uses described above. We will not claim authorship of Your Content.
OTHER MEMBERS' CONTENT. Other Members own their content and have granted Us the same license. You may not copy, modify, publish, transmit, distribute, perform, display, or sell another Member's content, except where it is in the public domain or you have written permission.
YOUR USE OF THE SERVICE: As a Member, You agree that:
(1) You will use the Service in a manner consistent with any and all applicable laws and regulations. You will not include in Your profile any personal contact information, social media handles, telephone numbers, street addresses, last names, URL's or email addresses, other than where You are specifically asked for such information in the Confidential Personal Information section of the Service. You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service. BuzzArab is intended for Members seeking serious, public, recognised marriage or long-term relationships. You will not use the Service if you are currently married. We do not facilitate temporary, unregistered, secret, or rights-waiving marriages, including but not limited to orfi, motaa, and mesyar marriage, and you will not use the Service to request, offer, or promote any such arrangement. You will not use the Service to propose or solicit fetish-based or BDSM arrangements. You will not transmit any chain letters or junk email to other members. You are solely responsible for Your interactions with other members. We reserve the right, but have no obligation, to monitor and/or mediate disputes between You and other members.
(2) You are solely responsible for the content or information You publish or display (hereinafter, "post") on the Service, or transmit to other members. You will not post on the Service, or transmit to other members or to Us or Our employees, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). You will not include in Your profile any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and You will not post any photos containing nudity or personal information. We reserve the right, but We have no obligation, to reject any profile or photo that does not comply with the prohibitions set forth in this section and, to the extent that We determine, in Our sole discretion, to do so, You shall not be entitled to a refund of any payments that We have received from You.
(3) Email and other communications sent from Us or through Us are designed to make your online personals experience enjoyable. By becoming a member, You specifically agree to accept and consent to receiving these communications initiated from Us or through Us including, without limitation: message notification emails, Your Match emails, emails informing you about events and parties We organize, emails informing You of promotions We run and emails informing You of changes to the Service. Should You not wish to receive any of Our email communications, please do not register with Us for the Service.
(4) You agree that We have no responsibility or liability for the deletion, corruption or failure to store any messages or other content maintained or transmitted by Our Service. You acknowledge that features, parameters or other services We provide may change at any time. You acknowledge that We reserve the right to sign out, terminate, delete or purge Your account from the Service if it is inactive. "Inactive" means that you have not signed in to the Service for a particular period of time, as determined by Us, in Our sole discretion.
We are entitled to investigate and terminate Your membership if You have misused the Service, or behaved in a way which could be regarded as inappropriate, unlawful or illegal. The following is a partial, but not exhaustive, list of the types of actions that are illegal or prohibited under this Agreement:
(a) You will not impersonate any person or entity. You will provide true and accurate information about yourself in Your Profile and all communications through us.
(b) You will not send improper, harassing, threatening, degrading, impolite messages or any messages that are out of the context that the Service is designed for.
(c) You will not express or imply that any statements You make are endorsed by Us, without Our specific prior written consent.
(d) You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or, in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
(e) You will not post, distribute or reproduce, in any way, any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
(f) You will not remove any copyright, trademark or other proprietary rights notices contained in the Service.
(g) You will not interfere with or disrupt any Service or any site, servers or networks connected to any Service, application or site.
(h) You will not post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
(i) You will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service.
(j) You will not "frame" or "mirror" any part of the Service, without Our specific prior written consent.
(k) You will not use meta tags or code or other devices containing any reference to Us or the Service or the site connected to the Service in order to direct any person to any other web site for any purpose.
(l) You will not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or any software used on or for the Service or cause or enable others to do so.
(m) If you have an existing Profile on the Service, you will not create, or attempt to create any additional Profiles on the Service.
(n) You will not send your contact information (phone number, email address, social media handle, etc) to other members you communicate with through the Service in an excessive manner.
(o) You will not ask other members you communicate with through the Service, in an excessive manner, for their contact information (phone number, email address, social media handle, etc).
(p) You will not circumvent or attempt to circumvent any of the limits on communication implemented in the Service. You will not access the Service using an IP-cloaking service such as a VPN, unless you are utilizing this service to overcome a country-level block on the Service.
INDEMNITY BY MEMBER: You will defend, indemnify, and hold Us and Our officers, directors, employees, agents and third parties harmless, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of Your use of the Service, including:
(I) Your breach of this Agreement; (II) any allegation that any materials that You submit to Us or transmit to the Service infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; and/or (III) Your activities in connection with the Service. This indemnity shall be applicable without regard to the negligence of any party, including any indemnified person.
ONLINE CONTENT: Opinions, advice, statements, offers, or other information or content made available through the Service, but not directly by Us, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SERVICE AND WE NEITHER ADOPT NOR ENDORSE NOR ARE WE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY PARTIES OTHER THAN US. UNDER NO CIRCUMSTANCES ARE BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE'S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICE, OR TRANSMITTED TO MEMBERS.
WE RESERVE THE RIGHT, BUT WE HAVE NO OBLIGATION, TO MONITOR THE MATERIALS POSTED IN THE ALL AND ANY AREAS OF THE SERVICE. WE SHALL HAVE THE RIGHT TO REMOVE ANY SUCH MATERIAL THAT, IN OUR SOLE DISCRETION, VIOLATES, OR IS ALLEGED TO VIOLATE, THE LAW OR THIS AGREEMENT. NOTWITHSTANDING THIS RIGHT, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST IN ANY AREAS OF THE SERVICE AND IN YOUR COMMUNICATIONS. COMMUNICATIONS BETWEEN YOU AND OTHER MEMBERS THAT ARE NOT READILY ACCESSIBLE TO THE GENERAL PUBLIC WILL BE TREATED BY US AS PRIVATE TO THE EXTENT REQUIRED BY APPLICABLE LAW.
INTELLECTUAL PROPERTY. All intellectual property rights in and to the Service are and shall be owned by Us, absolutely. Those rights include, but are not limited to, database rights, copyright, design rights (whether registered or unregistered), trademarks (whether registered or unregistered) and other similar rights, wherever existing in the world, together with the right to apply for protection of the same. All other trademarks, logos, service marks, company or product names set forth in Service are the property of their respective owners.
COPYRIGHT POLICY AND DMCA NOTICES. We respect intellectual property rights and expect Members to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act ("DMCA") and to equivalent notices under the laws of other jurisdictions.
Submitting a notice of alleged infringement. If you believe that content on the Service infringes your copyright, please send a written notice to our designated agent containing the following:
(a) a physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
(b) identification of the copyrighted work claimed to have been infringed;
(c) identification of the material on the Service that is claimed to be infringing, with sufficient detail to enable us to locate it (such as a URL or screenshot, and the username of the Member who posted it);
(d) your contact information (name, address, telephone, email);
(e) a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law;
(f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Counter-notice. If you believe your content was removed in error, you may send us a counter-notice containing: (a) your physical or electronic signature; (b) identification of the removed material and where it appeared before removal; (c) a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification; (d) your name, address, and telephone number; and (e) a statement that you consent to the jurisdiction of the federal court in the district where you live (or, if outside the United States, the federal court in any district in which we may be found), and that you will accept service of process from the person who submitted the original notice.
Repeat infringers. We will, in appropriate circumstances, terminate the accounts of Members who repeatedly infringe copyright.
Misuse of this process. Submitting a false notice or counter-notice may result in legal liability. We may, in our discretion, decline to respond to notices that are abusive, frivolous, or that do not comply with the DMCA.
PRIVACY: The personal information (including sensitive personal information) You provide to Us will be stored on computers. You consent to Our using this information to build up a profile of interests, preferences and browsing patterns and to allow You to participate in the Service. You also agree to read, review, comply with, uphold and maintain Our terms and conditions thereof. If you are located outside of the United States, please note that the information that you provide is being sent to the United States. By becoming a member of the Service, you consent to your data being sent to the United States and to such other third parties and jurisdictions as may be involved in the provision and operation of the Service...
DISCLAIMERS: WE PROVIDE THE SERVICE ON AN "AS IS" BASIS AND GRANT NO WARRANTIES OF ANY KIND, EXPRESSED, IMPLIED, STATUTORY, IN ANY COMMUNICATION WITH OUR REPRESENTATIVES, OR US OR OTHERWISE WITH RESPECT TO THE SERVICE. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FURTHER, WE DO NOT WARRANT THAT YOUR USE OF THE SERVICE WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE OR ERROR-FREE OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED WE DISCLAIM LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, CONNECTIVITY AND AVAILABILITY.
Although each member must agree to Our terms and conditions, We cannot guarantee that each member is at least the required minimum age, nor do we accept responsibility or liability for any content, communication or other use or access of the Service by persons under the age of 18 in violation of this Agreement. Also, it is possible that other members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Service and that You may be involuntarily exposed to such offensive and obscene materials. It also is remotely possible for others to obtain personal information about You due to Your use of the Service, and that the recipient may use such information to harass or injure You. We are not responsible for the use of any personal information that You disclose on the Service. Please carefully select the type of information that You post on the Service or release to others. WE DISCLAIM ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER MEMBERS OR USERS (INCLUDING UNAUTHORIZED USERS), WHETHER SUCH ACTS OR OMISSIONS OCCUR DURING THE USE OF THE SERVICE OR OTHERWISE.
LIMITATION OF LIABILITY: IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROGRAMS, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR SERVICE INTERRUPTIONS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE OR OUR AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR TO ANY PERSON OTHER THAN YOU. YOUR SOLE REMEDY IN THE EVENT OF ANY DEFICIENCY, DEFECT, FAILURE, ERROR OR INTERRUPTION SHALL BE TO REQUEST THAT We CORRECT THE MATTER OR, IF WE FAIL TO DO SO, TO DISCONTINUE USE OF THE SERVICE OR ANY RELEVANT GOODS OR SERVICES AT YOUR OPTION.
WE DO NOT CONDUCT BACKGROUND CHECKS OR OTHERWISE SCREEN THE MEMBERS REGISTERING TO THE SERVICE IN ANY WAY. AS A RESULT, WE WILL NOT BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL AND/OR CONSEQUENTIAL, ARISING OUT OF THE USE OF THIS SERVICE, INCLUDING, WITHOUT LIMITATION, DAMAGES ARISING OUT OF COMMUNICATING AND/OR MEETING WITH OTHER MEMBERS OF THE SERVICE, OR INDIVIDUALS INTRODUCED TO YOU VIA THE SERVICE. SUCH DAMAGES INCLUDE, WITHOUT LIMITATION, PHYSICAL DAMAGES, BODILY INJURY AND OR EMOTIONAL DISTRESS AND DISCOMFORT.
CHANGES TO THIS AGREEMENT. We may update this Agreement from time to time. The updated Agreement takes effect when We post it on the Service. Your continued use of the Service after a change takes effect constitutes your acceptance of the updated Agreement. If you do not agree to the changes, your remedy is to stop using the Service and, if you wish, to delete your account.
COMPLAINTS: To resolve a complaint regarding the Service, You should first contact Our customer service department.
DISPUTE RESOLUTION:
To the maximum extent allowed by applicable law the exclusive means of resolving any dispute or claim arising out of or relating to this Agreement (including any alleged breach thereof), the Service, shall be BINDING ARBITRATION administered by an arbitration association selected by the Company. Despite this section you have the right to bring an individual claim against the Company in a small-claims court of competent jurisdiction. But whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against the Company any class action, class arbitration, or other representative action or proceeding.
By using the Service in any manner, you agree to the above arbitration agreement. In doing so, YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend any claims between you and the Company (except for matters that may be taken to small-claims court). TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER CLASS PROCEEDING. Your rights will be determined by a NEUTRAL ARBITRATOR, NOT A JUDGE OR JURY. You are entitled to a fair hearing before the arbitrator. The arbitrator can grant any relief that a court can, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons.
This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Subject to the Dispute Resolution section above, the courts of British Columbia, located in Vancouver, shall have exclusive jurisdiction over any dispute arising from or relating to this Agreement, and You consent to personal jurisdiction in those courts.
Nothing in this Agreement deprives You of the protection of any mandatory consumer protection laws of Your country of residence that cannot be derogated from by agreement.
This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded.
